The following mentioned “Terms & Conditions” govern the relationship between you (client) and Yak Ru Adventure Pvt Ltd. (Service Provider). Make sure to thoroughly go through the contract and note that by booking a trip with us, you are agreeing to be bound by the Terms and Conditions, as well as the cancellation policy and certain limitations of liability. Both parties agree to these Terms and Conditions to resolve any legal or other disputes during the trip.
Booking and Cancellation
A trip includes any of the services you use. It includes Tours, Trekking, Mountain Biking, Peak Climbing, or any other outdoor programs. Your booking will only be confirmed if you receive a confirmation invoice or email from Yak Ru Adventure Pvt. Ltd. From this moment, the contract between the Company and the Client comes into existence.
The company can increase or decrease the service/package price unless your booking is approved and a contract comes into force.
*Note - The Company will not hold accountability for any insurance agreement, warranty, description of services, prior agreement, or conditions, other than as stated within the contract.
Booking and Payment Methods
20% of the total payment is required a month in advance to confirm any trip booking with us. The advance deposit can be made by bank transfer, Credit Card (Visa, MasterCard, and American Express), online via payment gateway, or Western Union.
The rest of the payment should be made before the trip, after arriving in Nepal.
Note: - The clients themselves should pay bank service charges at the time of deposit. While making advance deposits and payments, the customer must fill out the bank details correctly. Customers will be liable for any problems or issues raised due to incomplete or wrong information while making advance deposits and payments.
Cancellation Policy
Trips booked and subsequently canceled are subject to cancellation charges as follows:-
- 60 days prior: No cancellation charge,
- Within 30/59 days: 30%,
- Within 15/29 days: 40%,
- Within 8/14 days: 75%,
- Less than a week: 100%,
There will be no refund for the incomplete tour, trek, or expedition, whatever the reason from the customer’s side.
*Note: In case of special unforeseen events like political unrest, epidemics, weather issues, or natural calamities, the company or the guide holds the authority to change, modify, or even terminate the trip, and a refund will be done accordingly. The additional costs incurred due to the cases mentioned above should be borne by the clients themselves.
Risk and Liabilities
Medical conditions and special requirements:
In the event of any medical condition, please inform the company at the time of booking. A physically challenged condition or any other mental or physical incapacity that may hinder your ability to travel should be notified at the time of booking. Failure to notify the company may result in the client being refused travel. It may also result in losing the deposit or 100% of the trip cost.
There may be some trips that may be unsuitable for clients of a certain age, physical (mobility, pregnancy, etc.), or mental conditions. It is the client’s responsibility to check before booking. The company will not provide any special facilities unless it has agreed to do so in writing. The company will also do its best to meet the client's special requests, including dietary. Please note that such requests do not form part of the contract; therefore, the company is not liable for not adhering to these requests.
The medical facilities vary from country to country, and the company makes no representations and gives no warranties about the standard of such treatments.
Travel Insurance
1. Mandatory Travel Insurance
1.1 The Client agrees and acknowledges that comprehensive travel insurance is mandatory for participation in any tour, trek, expedition, or climbing activity (“Activities”) organized by the Company.
1.2 The Client shall obtain a valid insurance policy that provides coverage for the entire duration of the trip.
2. Minimum Insurance Coverage
2.1 The Client’s insurance policy must, at a minimum, include the following coverage:
a. Trip cancellation and interruption
b. Personal injury and accidental death
c. Medical expenses, including emergency treatment
d. Emergency evacuation and helicopter rescue
e. Repatriation of remains
f. Loss, theft, or damage to baggage and personal effects
2.2 The Client is solely responsible for ensuring that their insurance provider covers high-altitude trekking, mountaineering, adventure sports, or any specific activity included in the booked itinerary.
3. Proof of Insurance
3.1 The Company reserves the right to request proof of the Client’s insurance policy at any time before or during the Activities.
3.2 Failure to provide such proof upon request may result in denial of participation without refund.
4. Liability in Absence of Insurance
4.1 If the Client fails to obtain the required insurance, the Client agrees that they shall be entirely responsible for all expenses and liabilities arising from any incident, including but not limited to:
Medical care and hospitalization
Emergency evacuation or helicopter rescue
Repatriation
Loss or theft of personal items
Any damages or losses incurred during the trip
4.2 The Company shall bear no financial responsibility for any such expenses.
5. Risk Acknowledgement & Assumption of Responsibility
5.1 The Client acknowledges that the Activities involve inherent risks, including but not limited to altitude sickness, accidents, equipment failure, natural disasters, severe weather, and transportation hazards.
5.2 By signing this agreement, the Client voluntarily assumes all risks associated with participation in the Activities.
5.3 The Client agrees that the Company, its guides, employees, and representatives shall not be held liable for any injury, illness, loss, damage, or death unless caused by proven negligence of the Company.
Passport and Visas
All clients must have a valid passport with at least 6 months of validity from the return date. Nepalese visas can be obtained from the Nepalese Consulate in your country or upon arrival at Kathmandu Airport. Nepalese visa costs are the sole responsibility of clients.
Complaints
If you have any subject of complaints about the trip/tour, you must inform your trip or tour guide or team leader at the earliest opportunity, who will take the appropriate action or inform the company.
Governing Law and Jurisdiction
- This Agreement shall be governed by and interpreted in accordance with the laws of Nepal.
- Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts of Nepal.
Acknowledgement & Acceptance
By signing below, the Client confirms that they have read, understood, and agreed to all the terms and conditions outlined here.
